By accessing or using vist5.com ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform. We reserve the right to modify these Terms at any time, and continued use of the Platform constitutes acceptance of any changes.
You must be at least 13 years of age to use the Platform as a viewer. If you are between 13 and 18, you must have parental or guardian consent. By using the Platform, you represent and warrant that you meet these age requirements.
Creators who stream, monetize content, or receive payouts must be at least 18 years of age or the age of majority in their jurisdiction. This is required by our payment processor (Stripe) and is strictly enforced.
To access certain features of the Platform, you must create an account. You agree to provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
Creators on vist5.com may earn revenue through subscriptions, donations, and digital content sales. The revenue split is 83% to the creator and 17% to the Platform for subscriptions, and 100% to the creator for donations. To receive payouts, creators must connect a valid payment account through our payment processor (Stripe). Payouts are subject to Stripe's terms and processing times.
The Platform reserves the right to withhold or reverse payments in cases of fraud, chargebacks, Terms violations, or illegal activity. Creators are solely responsible for reporting and paying any applicable taxes on their earnings.
Important: Monetization of adult or sexually explicit content is strictly prohibited on the Platform. See Section 7 (Prohibited Content) and Section 8 (Acceptable Use Policy) for full details. Violations will result in immediate account termination and loss of all pending payouts.
Viewers may purchase subscriptions to support creators. Subscriptions are recurring monthly charges that can be cancelled at any time. Refunds for subscriptions are handled on a case-by-case basis. All payments are processed securely through Stripe. The Platform does not store credit card information.
Donations are voluntary, non-refundable contributions to creators unless required by law. By making a donation, you acknowledge that you are not purchasing a product or service.
You retain ownership of content you create, upload, or stream on the Platform ("User Content"). By posting User Content, you grant vist5.com a non-exclusive, worldwide, royalty-free license to host, display, distribute, and promote your content in connection with the Platform's operation.
You are solely responsible for your User Content. You represent that you have all necessary rights to post your content and that it does not infringe on any third-party rights.
You agree not to use the Platform to:
vist5.com maintains a strict Acceptable Use Policy. By using the Platform, you agree to abide by all rules outlined in these Terms, including the following key policies:
Prohibition on Adult & Sexually Explicit Content: The monetization of adult or sexually explicit content is strictly prohibited on vist5.com. This includes, without limitation: pornographic material, nudity intended for sexual gratification, sexual acts or performances, sexually suggestive content marketed or sold for arousal, and any other adult content as determined by the Platform. This prohibition applies to all Platform features and all forms of monetization — including streaming, subscriptions, donations, tips, digital store sales, behind-the-scenes content, and any other revenue-generating mechanism on the Platform. Any attempt to monetize adult or sexually explicit content will result in immediate and permanent account termination, disconnection of the associated Stripe Connect payout account, and forfeiture of any pending or future payouts.
Detection & Monitoring: The Platform uses a combination of automated systems and manual review to detect and prevent violations. Administrators actively monitor content and user reports.
Reporting: Any user can report content or behavior that violates these Terms using the report functionality available on stream pages. Reports can also be submitted via email to support@vist5.com.
Repeat Violator Policy:
Severe violations (including but not limited to CSAM, adult/sexually explicit content monetization, threats of violence, fraud, or illegal activity) may result in immediate permanent termination without prior warning. We reserve the right to report illegal activity to appropriate law enforcement authorities.
Creators may sell digital content (files, overlays, LUT packs, etc.) through the Platform's store. Creators are responsible for ensuring their digital products do not violate intellectual property laws or these Terms. The Platform takes no responsibility for the quality or functionality of digital products sold by creators.
Buyers of digital products receive a personal, non-transferable license to use purchased content. Redistribution or resale of purchased digital content is prohibited unless explicitly permitted by the creator.
We respect intellectual property rights and comply with the Digital Millennium Copyright Act (DMCA). If you believe your copyrighted work has been infringed on the Platform, please submit a DMCA takedown notice to us. We will promptly investigate and remove infringing content.

Counter-Notification: If you believe your content was wrongly removed, you may submit a counter-notification to support@vist5.com with the information required under 17 U.S.C. 512(g).
Repeat Infringers: In accordance with the DMCA, we will terminate the accounts of users who are repeat copyright infringers.
Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Platform, you consent to the practices described in the Privacy Policy.
We may suspend or terminate your account at any time, with or without cause, with or without notice. Grounds for termination include but are not limited to: violation of these Terms, fraudulent activity, extended inactivity, or at our sole discretion. Upon termination, your right to use the Platform ceases immediately.
You may delete your account at any time through your Account Settings in the Dashboard. Upon account deletion, we will remove your public profile and content within a reasonable timeframe, subject to legal retention requirements.
The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Platform will be uninterrupted, secure, or error-free. We are not responsible for any content streamed, uploaded, or shared by users.
To the maximum extent permitted by law, vist5.com and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of the Platform. Our total liability shall not exceed the amount you have paid to the Platform in the twelve (12) months preceding the claim.
You agree to indemnify and hold harmless vist5.com and its operators, employees, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Platform, your User Content, or your violation of these Terms.
These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration, except where prohibited by law.
We reserve the right to update these Terms at any time. We will notify users of material changes by posting the updated Terms on the Platform with a new "Last updated" date. Your continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.
